1. These terms

These are the terms and conditions on which we supply Gift Cards to you, together with the “Summary of Terms” listed on the Gift Card.

You should read these terms and conditions carefully before using this website. By using this website or otherwise indicating your consent, you acknowledge and agree to be bound by these terms and conditions and undertake to unequivocally agree to comply with them.

We may amend these terms and conditions from time to time. Each time you wish to use our website, please ensure that you have carefully read and understood the terms and conditions as amended. Ignorance of these terms and conditions as amended shall not be a valid defence under whatever circumstances.

2. Information about us and how to contact us

We are Loopbox Ltd, trading as Giftdotmu or Gift.mu, a company registered in Mauritius. Our company registration number is C118549 and our registered office is at Avenue des Flamboyants Morcellement Carlos Tamarin, Mauritius.

3. Gift Card/Corporate Gift Service

3.1 Gift Card

Our website is solely for the promotion and redemption of Gift Cards in Mauritius. Gift Cards can be spent via participating merchants whose name appears on the Gift Card.

We are only the aggregator of deals and issuer of Gift Cards. The Gift Cards and the deals are the property of the participating merchants whose names appear on the Gift Cards, and we are not responsible for the safety, legality, quality or any other aspect of the goods or services purchased with a Gift Card.

A Gift Card is valid for the period stated on it. The Gift Card will cease to be valid at the expiry date stated on it. On that date, the Gift Card will cease to function and you will no longer be entitled to use it.

The value of the Gift Card will be stated on it. The Gift Cards will automatically be activated on the date and time the delivery of the Gift Card is scheduled for, provided the order has been approved by our system first. If there is any issue with the Gift Card activation you may contact our customer services.

3.2 Corporate Gift Service

Corporate Gift Service is a service offered to entities that allows them to access our services, including Gift Card services, for the benefit of others.

4. Participating merchants

Our list of participating merchants is dynamic and may be subject to change at any time, without prior notice, for various reasons, including but not limited to:

  • contractual agreements with the participating merchants;
  • business decisions impacting our participating merchant network;
  • market dynamics influencing our selection of participating merchants; or
  • other factors that may necessitate adjustments to our list of participating merchants.

We reserve the sole and exclusive right to modify, update or revise the list of participating merchants on our system at our absolute discretion and without prior notice.

You are responsible for staying informed about changes regarding our network of participating merchants. To facilitate this, we encourage you to regularly check our website (https://storefront.gift.mu/mu/gift-cards) or contact our customer support for the most up-to-date and accurate list of participating merchants.

5. Using your Gift Card

Gift Cards are redeemable for goods or services of participating merchants. The merchants, not us, are the sellers of the goods and services and each merchant is solely responsible for redeeming any Gift Card you purchase.

The Gift Cards can be redeemed through one of the following processes:

  1. Gift Cards can be redeemed directly from the SMS or email received, without creating an account with Gift.mu. Instructions for this redemption process can be accessed here.
  2. Gift Cards can be redeemed directly in-store with the merchant or by calling Gift.mu’s helpdesk during operating hours (10:00am to 18:00pm) for a remote redemption. Remote redemptions are subject to our availability to answer the helpdesk. We will not be held liable, should we be unable to process the remote redemption upon your calling.

You will not be entitled to receive credit or cash-back for whatever value of the Gift Card that you do not use.

You cannot combine the Gift Card offer with other special offers or promotions that may be available, with Gift.mu and participating merchants, unless mentioned on the Gift Card or accepted in store by the merchant.

Once a Gift Card is redeemed, the transaction cannot be reversed. The merchant will deduct the Gift Card value from the value of the full purchase.

If the value of a purchase exceeds the Gift Card value, then you will have to pay the outstanding amount of the purchase.

Gift Cards are multi-use and can be used only at the designated merchant, except our Happy Card by Gift.mu that is redeemable at any merchant who is part of our network.

Gift Cards that are redeemed for Rs 150 or less must be redeemed for its full value.

If a Gift Card is not redeemed for its full value, the remaining balance will still be available on it to be redeemed. Gift Card balances will be updated immediately if there is an active internet connection; if not, it will be updated as soon as an internet connection is available.

It is your responsibility to make sure that you enter the correct amount when redeeming your Gift Card. The merchant cannot void the transaction once you have initiated the redemption.

To use our Gift Cards, you must have an active internet connection to your mobile device.

We reserve the right to cancel and re-issue any Gift Cards at our sole discretion where such cancellation and re-issuance has been reasonably requested by you.

If you possess a Gift Card for a specific participating merchant that is later removed from our network, you will need to contact us. We will take one of the steps below to remedy the issue:

  1. If we have a pre-existing agreement with a Corporate Gift Service, we will liaise with the entity who purchased the Gift Card(s) to explore potential solutions, including but not limited to issuance of a new gift card to you; or
  2. If we do not have a pre-existing agreement with a Corporate Gift Service, we will convert the value of your Gift Card into a Happy Card, offering you the flexibility to use it at any of the participating merchants within our network. The Happy Card is designed to ensure that the value of your original Gift Card is not lost.

The resolution process may vary depending on the specific circumstances and contractual arrangements in place with each participating merchant in our network. We are fully committed to ensuring the best possible resolution for you in these situations.

6. Gift Cards are non-refundable

We do not offer refunds. Gift Cards once sold are non-refundable, whether you use it or not.

If a Gift Card is not successfully delivered through our system, it is your responsibility to promptly inform us.

If we cannot deliver a Gift Card to you for any reason whatsoever (including an event outside our control) then we will contact you as soon as possible to let you know. Provided we do this, we will not be liable for delays caused by the event. If there is a risk of substantial delay, you may contact us to receive a refund for any Gift Cards you have paid for but not received.

Gift Cards are valid for one year from the date of issue, and their validity period cannot be extended. After one year, Gift Cards will become invalid and the balance of money on the Gift Card cannot be refunded. If a Gift Card expires with a remaining balance, the balance of the money remaining on the Gift Card will be forfeited and become our revenue.

If you are entitled to a refund under these terms, we will refund you the price you paid for the Gift Cards, by the method you used for payment or any other method we deem appropriate, and we will make any refunds due to you as soon as possible.

7. Restrictions on use of Gift Cards

7.1 Resending and changing delivery details

If a Gift Card, originally sent via email or SMS, is either misplaced by you or undelivered to you, you may request us to resend the Gift Card to the original email address or mobile number to which it was initially sent. This service will be provided to you without requiring additional verification, provided that the request is made using the same email address or mobile number as the original delivery channel.

If you request to have a Gift Card resent to a new email address or mobile number not recognised in our system as the original delivery channel, the following procedures will need to be adhered to:

  1. You will need to make a formal request by sending an email to hello@gift.mu, providing the following details:
  • full name of the recipient;
  • full name of the sender/purchaser (individual or company);
  • original email address or mobile number; and
  • reason for the change in delivery details; and
  1. Following the formal request, you will be required to complete a multi-step verification process which may include the following:
  • answering security questions previously established during the purchase;
  • providing a copy of a government-issued identification document matching the recipient’s full name;
  • submitting a recent transaction receipt or other valid proof of purchase; and
  • completing a phone verification process, if deemed necessary.

The request for changing delivery details will be subject to approval by our security team after a thorough examination of all provided information and documents.

We reserve the right to refuse any requests for changes of delivery details if the information provided is inconsistent, incomplete, or gives rise to suspicions of fraudulent activity.

At our absolute discretion, we may choose to contact the purchaser of the Gift Card as part of our verification or investigation process.

We will not be held liable for any losses or inconveniences caused by delays, refusals, or additional verification measures associated with changing delivery details.

For Gift Cards provided to entities via URL links for distributions to recipients, the entity is solely responsible for ensuring that the recipients receive the Gift Card by managing and safeguarding the distributions of URL links.

The entity shall maintain adequate records of the distribution of Gift Card URL links, including but not limited to records pertaining to the specific URL link sent to each recipient, the date of distribution, and the channel used for transmission.

If the recipient loses the URL link, the sole responsibility for resending the URL link to the recipient rests with the entity and will not fall within our services.

Once Gift Cards URL links have been provided to the entity, we cannot track or monitor the URL links. Consequently, we shall not be held liable for any unauthorised access, unauthorised distribution, or loss of Gift Cards URL links.

Any failure, neglect, or omission on the part of the entity for maintaining accurate records, ensuring the secure distribution of Gift Cards URL links, or addressing/handling the loss of Gift Cards URL links shall be the sole responsibility and liability of the entity, and not our responsibility and liability.

We will handle and process all recovery requests for Gift Cards in accordance with our standard procedures, and we will promptly communicate the applicable timeframe for the recovery or resend process.

We retain the absolute right to decline requests for recovery or resend of Gift Cards in cases of reasonable suspicion of fraudulent or unauthorised activity associated with the request.

We shall not be held liable for any losses, damages, or inconveniences incurred due to misplacement, unauthorised access, or non-adherence to the procedures outlined in this clause 7.

7.2 Usage restrictions

Gift Cards can be spent via participating merchants (see article 4) whose names appear on the Gift Cards.

You must not attempt to use your Gift Card via non-participating merchants.

Once a Gift Card has been issued, it cannot be topped up with more funds.

A Gift Card may not be exchanged for cash in store.

A Gift Card cannot be used to withdraw cash via ATMs, banks or other institutions.

A Gift Card is not permitted to be used for the purposes of purchasing foreign currency.

A Gift Card is not permitted to be used for the purpose of purchasing other Gift Cards.

A Gift Card is not linked to a:

  • bank account;
  • cheque guarantee card;
  • charge card; or
  • credit card.

A Gift Card balance does not attract interest.

A Gift Card is neither permitted nor suitable to be used for the purposes of identification.

A Gift Card may not be used for preauthorised regular payments, for gambling, or for any illegal purposes.

A Gift Card may not be combined with other Gift Cards for a single purchase, unless stated otherwise on the Gift Card.

We may restrict use of your Gift Card if we suspect that the Gift Card is being used for, or is in any way associated with, fraudulent or other illegal activities.

8. Placing an order

We shall supply such quantities of Gift Cards as you may order.

Each order placed by you is an offer by you to purchase the goods specified in the order subject to these terms and conditions.

You are responsible for ensuring the accuracy and completeness of your order and any specification (such as email address, mobile number, or other recipient details) submitted by you is complete and accurate. We cannot be held liable for any errors including incorrect, inaccurate, or incomplete information submitted to us for an order.

Our acceptance of your order takes place when we send you the sales order or invoice details. Sales orders are sent to all individuals or companies buying directly on our site (https://storefront.gift.mu/mu). Invoices are only sent for Corporate orders that are not directly done on site.

We will generate one Gift Card for each order of Gift Cards placed by you and we will transmit the details to the recipient or to you if requested for a Corporate order. Depending on the situation and if allowed by our system, you or the recipient may transfer, transmit or share the details of the Gift Cards to any person via any medium (including but not limited to email, SMS or messaging applications).

9. Delivery and transfer of title and risk

Delivery is considered complete when the Gift Cards are sent to you electronically via SMS or email, and at that point, ownership and responsibility for the Gift Cards will transfer to you, whether you take notice or not of the delivery that was effected.

We are not responsible for any Gift Cards that are lost, stolen, misplaced, or used by anyone unauthorized after delivery. To ensure added security, we recommend creating an account with Gift.mu and storing your Gift Cards in our gift card wallet. We will not be held liable for any Gift Card theft that occurs outside of the secure Gift.mu environment. We will not be held liable for any re-transmission and subsequent transfer or sharing of the Gift Card details effected by you or the recipient.

If any delivery goes to the wrong recipient because of errors on your part, and it was processed based on your order, you accept full responsibility for the misdelivery. We won't be held liable for any such misdelivery.

10. Price and payment

The price of the Gift Card (which includes VAT) will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the Gift Card advised to you is correct. However, please see clause 10.2 for what happens if we discover an error in the price of the Gift Card you order.

It is always possible that, despite our best efforts, some of the Gift Cards we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the Gift Card's correct price at your order date is less than our stated price at your order date, we will charge the lower amount.

If the Gift Card's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.

If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognized by you as a mispricing, we may cancel the Gift Card and refund you any sums you have paid.

11. Our responsibility for loss or damage suffered by you

To the fullest extent permitted by law:

  • we shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and
  • our total liability to you for all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the refund of the total sums paid by you for a specific Gift Card.

12. Privacy policy

We will only use your personal information as set out in our Privacy Policy.

13. Governing law and jurisdiction

These terms are governed by the laws of Mauritius and either of us can bring legal proceedings in respect of the Gift Cards in the courts of Mauritius.
